What may you do before accepting an inheritance?

You may need to act after a death, but some actions can have legal consequences for acceptance.

After a death, you naturally want to act. The home must remain safe, the funeral must be arranged and bills arrive. Still, caution is needed as long as you have not chosen whether to accept unconditionally, accept beneficially or reject the inheritance.

What requires extra attention?

Do not sell estate goods and do not take them for yourself. Do not use the deceased person's money as if it is already your inheritance. Such actions can be seen as unconditional acceptance, with possible liability for debts. Paying the funeral from the estate is, according to the Dutch government, an exception in itself.

You can collect information, make an initial inventory and ensure assets are not lost. Document what you do and why. If immediate action is needed to prevent damage, it is wise to ask legal advice beforehand about the right way to proceed.

Decide only after an initial overview

Ask whether there is a will and an executor. Investigate bank accounts, loans, outstanding costs and the home. If the financial situation is uncertain, discuss beneficial acceptance with a notary. If rejecting, also consider the position of children who may then become heirs.

The Inheritance Guide helps separate practical steps from decisions with legal consequences, so you have room to make a considered choice.
